What SMSF lending does BGW assist with?

BGW assists with credit for eligible commercial property purchases through a self-managed super fund and with refinancing an existing residential property loan already held in an SMSF. BGW does not assist with new residential property purchases through an SMSF.

An SMSF property transaction can involve the fund trustee, a separate holding trustee, a limited recourse borrowing arrangement (LRBA) and strict documentation. Under an LRBA, the lender’s rights of recovery against the fund are generally limited to the asset acquired under the arrangement. Separate guarantees can create additional obligations, so the documents need specialist review. Get advice from appropriately qualified legal, accounting and financial advisers before signing contracts or loan documents. They should determine the correct structure and sequence for the property and jurisdiction.

The order of steps matters. Changing contracts, trustee names or holding-trust arrangements after signing can be difficult and costly. Brion can explain the lender’s documentation expectations, but cannot establish the SMSF, holding trust or investment strategy.

Before committing to a property or refinance, obtain advice on compliance, ownership, liquidity, tax, legal documents and whether the strategy is appropriate for the fund and its members.

How a lender may view the application

A lender may assess fund contributions, rental income, liquidity, existing liabilities, property type, lease terms and the proposed repayment position. Requirements and acceptable structures vary materially between lenders.

For commercial property, the lender may also review the tenant, lease and any relationship between the fund members, business and property. A clear application should explain the complete arrangement.
