An SMSF property transaction can involve the fund trustee, a separate holding trustee, a limited recourse borrowing arrangement (LRBA) and strict documentation. Under an LRBA, the lender’s rights of recovery against the fund are generally limited to the asset acquired under the arrangement. Separate guarantees can create additional obligations, so the documents need specialist review. Get advice from appropriately qualified legal, accounting and financial advisers before signing contracts or loan documents. They should determine the correct structure and sequence for the property and jurisdiction.

For commercial property, the lender may also review the tenant, lease and any relationship between the fund members, business and property. A clear application should explain the complete arrangement.
